Language. These Terms are also offered in Spanish as a courtesy. If there is any conflict or difference in meaning between the English and Spanish versions, the English version controls.

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of the Vic’s Hot Sauce website (the “Site”), operated by or on behalf of Vic’s Hot Sauce (“Vic’s Hot Sauce,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Eligibility

The Site is intended for users who are at least 18 years old, or who use the Site with the involvement and permission of a parent or guardian. If you use the Site on behalf of a minor, you do so under your own supervision and responsibility.

3. The Site Is Informational

The Site presents information about Vic’s Hot Sauce and its products. Information on the Site — including product descriptions, flavors, heat levels, availability, and any future pricing — is for general informational purposes and may change. Nothing on the Site is an offer, a guarantee of availability, or a binding commitment unless and until we confirm it directly.

4. Contacting Us and the VIP Club

You may send us a message through the contact form and may sign up for our VIP Club to receive email updates. You agree that any information you submit is accurate and that you have the right to provide it. By joining the VIP Club you consent to receive email updates from us; you can unsubscribe at any time using the link in any message or by emailing hello@vicshotsauce.com. Our handling of the information you submit is described in our Privacy Policy.

5. Products and Future Online Ordering

The Site does not currently sell products or process payments. If and when we make products available for purchase through the Site, additional sale terms will apply and the following will govern those purchases:

• Orders are offers to buy that we may accept or decline. We may limit quantities, refuse, or cancel an order — including after it is placed — for reasons such as product unavailability, a suspected error, or a suspected fraudulent or unauthorized transaction.
• Prices, product descriptions, and availability may change at any time and may contain errors; we reserve the right to correct any error and to cancel an affected order even after it is confirmed. Where an order is cancelled after payment, your sole remedy is a refund of the amount charged for the cancelled items.
• Product photos and descriptions are intended to be accurate but are approximate; small-batch products naturally vary in color, heat, and flavor from batch to batch.
• Shipping, delivery timeframes, and returns are described in our Shipping & Returns policy, which is part of these Terms.

6. Food Product — Important Safety and Use Notice

Our products are hot sauces and pique made for human consumption. Please use common sense and read the product label, which controls.

• Spice / heat caution. These are spicy products that contain hot peppers (capsaicin). Use in moderation, keep out of the reach of children, and avoid contact with your eyes, skin, and other sensitive areas. Capsaicin can cause burning, irritation, or discomfort.
• Allergens and ingredients. Always read the ingredient and allergen information on the product label before consuming, especially if you have a food allergy or sensitivity. If you are unsure whether a product is right for you, do not consume it.
• Health. If you are pregnant or nursing, are giving the product to a child, or have a medical condition (including any digestive condition), use your judgment and consult a qualified healthcare professional. We make no health, medical, nutritional, or therapeutic claims about our products; nothing on the Site is intended to diagnose, treat, cure, or prevent any disease.
• Storage. Follow any storage and refrigeration instructions on the label.

7. Reviews, Taste, and Individual Experience

Any reviews, comments, or early feedback shown on the Site reflect the personal, subjective experiences and tastes of the individuals who gave them. Taste, heat tolerance, and preferences vary from person to person, and these comments are not a promise or guarantee that you will have the same experience.

8. Acceptable Use

You agree to use the Site only for lawful purposes and not to:

• use the Site in any way that violates applicable law or these Terms;
• submit content that is unlawful, harassing, abusive, defamatory, or infringing;
• attempt to gain unauthorized access to, disrupt, overload, or interfere with the Site; or
• use automated means to scrape, copy, or harvest content from the Site except as expressly permitted.

We may suspend or terminate access for any user who violates these Terms or misuses the Site.

9. Intellectual Property

The Site and its contents — including text, graphics, logos, photographs, layout, recipes shown for serving ideas, and the “Vic’s Hot Sauce” name and branding — are owned by Vic’s Hot Sauce or its licensors and are protected by intellectual-property laws. You may view and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Site without our prior written permission. All rights not expressly granted are reserved.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES WITH RESPECT TO THE SITE AND ITS CONTENT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

This Section 10 applies to the website and its content. It does not limit or disclaim any warranty or right that applies to a physical product you actually purchase from us, and it does not exclude or limit any warranty or liability that cannot be excluded or limited under applicable law (including non-waivable consumer rights and the implied warranty that food sold for consumption is fit to eat). Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VIC’S HOT SAUCE AND ITS OWNER, OPERATORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), OR, IF GREATER, THE AMOUNT YOU PAID US FOR ANY PRODUCT GIVING RISE TO THE CLAIM.

NOTHING IN THIS SECTION LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY A DEFECTIVE PRODUCT, FOR FRAUD, FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR FOR ANYTHING THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of these limitations may not apply to you; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Vic’s Hot Sauce and its owner, operators, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the Site; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) content you submit through the Site.

13. Third-Party Links

The Site may link to third-party websites or services that we do not operate or control, such as our Facebook page. We are not responsible for the content, products, or practices of any third-party site, and your use of them is at your own risk.

14. Changes to the Site and These Terms

We may modify, suspend, or discontinue all or part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after an update means you accept the updated Terms.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to any rights you may have under the law of your home jurisdiction, you agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts. Nothing in this section deprives a consumer of the protection of the mandatory consumer-protection laws of the place where they reside.

16. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and (once active) our Shipping & Returns policy, are the entire agreement between you and Vic’s Hot Sauce regarding your use of the Site. Our failure to enforce any provision is not a waiver of it.

1. Aceptación de Estos Términos

Estos Términos de Servicio (“Términos”) rigen tu acceso y uso del sitio web de Vic’s Hot Sauce (el “Sitio”), operado por o en nombre de Vic’s Hot Sauce (“nosotros”). Al acceder o usar el Sitio, aceptas estos Términos. Si no estás de acuerdo, por favor no uses el Sitio.

2. Elegibilidad

El Sitio está destinado a personas de al menos 18 años, o que lo usen con la participación y el permiso de un padre o tutor. Si usas el Sitio en nombre de un menor, lo haces bajo tu propia supervisión y responsabilidad.

5. Productos y Ventas en Línea Futuras

El Sitio actualmente no vende productos ni procesa pagos. Si y cuando ofrezcamos productos a la venta por el Sitio, aplicarán términos de venta adicionales y regirá lo siguiente:

• Los pedidos son ofertas de compra que podemos aceptar o rechazar. Podemos limitar cantidades, rechazar o cancelar un pedido — incluso después de realizado — por razones como falta de disponibilidad, sospecha de error o sospecha de una transacción fraudulenta o no autorizada.
• Los precios, descripciones y disponibilidad pueden cambiar en cualquier momento y pueden contener errores; nos reservamos el derecho de corregir cualquier error y de cancelar un pedido afectado aun después de confirmado. 6. Producto Alimenticio — Aviso Importante de Seguridad y Uso

Nuestros productos son salsas picantes y pique para consumo humano. Usa el sentido común y lee la etiqueta del producto, que prevalece.

• Precaución por picante. Son productos picantes que contienen ajíes (capsaicina). Úsalos con moderación, manténlos fuera del alcance de los niños y evita el contacto con los ojos, la piel y otras zonas sensibles. La capsaicina puede causar ardor o irritación.
• Alérgenos e ingredientes. Lee siempre la información de ingredientes y alérgenos en la etiqueta antes de consumir, en especial si tienes una alergia o sensibilidad alimentaria. Si no estás seguro de que un producto sea adecuado para ti, no lo consumas.
• Salud. Si estás embarazada o amamantando, das el producto a un niño, o tienes una condición médica, usa tu criterio y consulta a un profesional de la salud. No hacemos ninguna declaración de salud, médica, nutricional o terapéutica sobre nuestros productos; nada en el Sitio pretende diagnosticar, tratar, curar o prevenir enfermedad alguna.
• Almacenamiento. Sigue las instrucciones de conservación y refrigeración de la etiqueta.

7. Reseñas, Gusto y Experiencia Individual

Cualquier reseña, comentario u opinión temprana mostrada en el Sitio refleja las experiencias y gustos personales y subjetivos de quienes los dieron. El gusto, la tolerancia al picante y las preferencias varían de persona a persona, y estos comentarios no son una promesa ni garantía de que tendrás la misma experiencia.

8. Uso Aceptable

Aceptas usar el Sitio solo para fines lícitos y no: usarlo de forma que viole la ley o estos Términos; enviar contenido ilícito, acosador, abusivo, difamatorio o infractor; intentar acceder sin autorización, interrumpir o interferir con el Sitio; ni usar medios automatizados para extraer o copiar contenido salvo permiso expreso. Podemos suspender o terminar el acceso de quien viole estos Términos.

9. Propiedad Intelectual

El Sitio y su contenido — texto, gráficos, logotipos, fotografías, diseño, recetas mostradas como sugerencias y el nombre y la marca “Vic’s Hot Sauce” — son propiedad de Vic’s Hot Sauce o sus licenciantes y están protegidos por leyes de propiedad intelectual. Puedes ver y usar el Sitio para fines personales y no comerciales. No puedes copiar, reproducir, distribuir, modificar, crear obras derivadas, mostrar públicamente ni explotar comercialmente parte alguna del Sitio sin nuestro permiso previo por escrito. 12. Indemnización

Aceptas indemnizar y mantener indemne a Vic’s Hot Sauce y a su dueño, operadores, empleados, agentes y proveedores frente a reclamos, responsabilidades, daños, pérdidas y gastos (incluidos honorarios razonables de abogados) que surjan de: (a) tu mal uso del Sitio; (b) tu incumplimiento de estos Términos; (c) tu violación de la ley; o (d) el contenido que envíes por el Sitio.

13. Enlaces a Terceros

El Sitio puede enlazar a sitios o servicios de terceros que no operamos ni controlamos, como nuestra página de Facebook. No somos responsables de su contenido, productos o prácticas, y los usas bajo tu propio riesgo.

14. Cambios al Sitio y a Estos Términos

Podemos modificar, suspender o descontinuar todo o parte del Sitio en cualquier momento sin aviso. También podemos actualizar estos Términos; al hacerlo revisaremos la fecha de “Última actualización”. El uso continuado del Sitio tras una actualización significa que aceptas los Términos actualizados.

15. Ley Aplicable y Jurisdicción

Estos Términos se rigen por las leyes del Estado de Florida, sin atender a sus normas de conflicto de leyes. Sujeto a los derechos que tengas bajo la ley de tu lugar de residencia, aceptas que toda disputa relacionada con estos Términos o el Sitio se presente exclusivamente en los tribunales estatales o federales ubicados en Florida, y consientes su jurisdicción personal. 16. Divisibilidad y Acuerdo Íntegro

Estos Términos, junto con nuestra Política de Privacidad y (una vez activa) la política de Envíos y Devoluciones, constituyen el acuerdo íntegro entre tú y Vic’s Hot Sauce sobre tu uso del Sitio.
